CIPAA does not allow defences like back-to-back payment clause or pay-when-paid clause and thus the contractor can still proceed with CIPAA even back-to-back payment clause exists in the contract.
It is the spirit of CIPAA that all contractors who successfully obtained an Adjudication Decision must be paid first even when the losing party intends to finally settle the dispute at Court or Arbitration.
CIPAA allows the winning party to enforce the Adjudication Decision against the Employer of the losing party for direct payment.
CIPAA applies to every written construction contract and for works carried out either wholly or partly in Malaysia. The definition of written construction is so broad that it includes Purchase Order and Delivery Order claim
CIPAA does not apply to construction contract for building works :
1) Below 4 Storeys High;
2) for self-occupation;and
3) entered by natural person.
If the Adjudication Decision is decided in your favour, you can recover all the out of pocket expenses including the adjudication fee and consultant fee spent on the adjudication proceeding.
